Information Memorandum pursuant to art. 13 of Italian
Legislative Decree 196/2003
Datalogic S.p.A. Via Candini 2 – 40012 Lippo di Calderara di Reno (BO),
("Data Controller") in accordance with art.13 of Italian Legislative Decree
no.196/2003 ("Privacy Code"), provides this information about privacy in
order to describe the processing of any personal data provided by the data subjects
("Data"). This processing concerns only such Data, which shall be processed
pursuant to the information provided herein. The data subject is not required to
reveal data which may be regarded as sensitive according to art. 4, paragraph 1,
letter d) of the Privacy Code, i.e. which may provide indications as to the health
condition, racial and ethnic origin, religious beliefs, political opinions, sexual
orientation. If this should be necessary for the purposes listed under item 1 "Data
treatment methods and purpose" of this Information Memorandum, such sensitive data
shall be collected and treated exclusively on the condition that the relevant consent
being issued by the data subject.
1) DATA PROCESSING METHODS AND PURPOSE
The Data may be processed either manually or by electronic means for the following purposes:
a. complying with an obligation imposed by a law, regulations or Community legislation;
b. conducting any research and selection work for possible candidates to
be employed by the Data Controller and/or by companies of the Datalogic Group, as
part of contract related to a fixed-term or permanent position or of a work experience
and/or training period;
c. any notification pertaining to possible training and/or initiatives
or events which are organized and/or sponsored by the Data Controller and/or by
companies of the Datalogic Group, also with a view to informing about the offers
and skills required;
d. dissemination of information regarding any Datalogic Group activities
and the events in which companies of the Datalogic Group are taking part;
e. operating management as regards browsing the portal from the address http://www.datalogic.com/Open_day
with the relevant access data, also for the purpose of the data and portal safety.
All notifications referred to under items (c) and (d) may also be sent by e-mail.
The Data may be organized and stored as part of databases property and/or under
the control of the Data Controller; in this respect the Data may be stored for up
to one (1) year after they have been collected.
The Data shall be processed directly by Datalogic S.p.A. through its employees,
which will be specifically appointed as “Persons in charge of the data processing”.
2) DISSEMINATION AND COMMUNICATION OF THE DATA
As part of the purposes listed in this Information Memorandum, the Data may be communicated
within the Datalogic Group, to departments or offices of the said Group in Italy
and abroad, also in countries outside the European Union where companies that are
part of the Datalogic Group operate, which will process the data as independent
treatment owners, as well as to companies or organizations – all of them duly appointed
as Data Processors – which cooperate in pursuing and implementing the purposes referred
to in this Information Memorandum.
3) NATURE OF DATA PROVIDING AND CONSEQUENCE OF A REFUSAL
Any provision of Data by the data subject concerned is optional, although essential
for the work done by the Data Controller (and – if applicable – by the entities
referred to under item 2) of this Information Memorandum), listed under letters
(b), (c), (d) and (e); any failure to agree to the provision would make it impossible
for the Data Controller and for the entities referred to under item 2) of this Information
Memorandum to carry out the above mentioned data processing.
4) RIGHTS OF THE DATA SUBJECT
The data subject may exercise the rights pursuant to art. 7 of the Privacy Code;
in this respect, the data subject is entitled to obtain information about any personal
data regarding him or her, even if they have not been registered yet, as well as
to be notified about them in a legible format.
The person concerned is entitled to be informed about:
a. the source of personal data;
b. the purpose and methods of the processing;
c. the logic applied to the processing, if the latter is carried out with the help of electronic means;
d. the identification data concerning Data Controller, Data processors
e. the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
The data subject concerned is also entitled to:
a) updating, rectification or, where interested therein, integration of the data;
b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected
The data subject shall have the right to object, totally or in part:
a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
