Datalogic Scanning GmbH Brings Suit against Metrologic Instruments GmbH
Datalogic Scanning Alleges Patent Infringement
Darmstadt, Germany, July 3, 2007 – Datalogic Scanning GmbH, part of the Datalogic Group, announced that it has filed suit against Metrologic Instruments GmbH in the German Court for infringement of German patent 44 47 992, a counterpart to two U.S. patents, Nos. 6,974,084 and 6,991,169. The suit is directed to Metrologic’s family of bi-optic scanners including the Stratos H, Stratos E and Stratos S. In the suit, Datalogic Scanning seeks injunctive relief enjoining Metrologic from continuing to manufacture, use, sell or offer to sell any such devices. In addition, Datalogic Scanning seeks monetary damages and its attorneys' fees.
Datalogic Scanning’s Magellan® bi-optic product line, which embodies technology covered by the German patent now asserted and its two US counterparts, are the highest performing fixed point-of-sale scanners in the world and also have the most aggressive scan patterns in the industry. They quickly read bar codes on five or six sides of an item using Datalogic Scanning SurroundScan® 3D Scanning technology. With this technology, checkers no longer need to orient an item’s bar code, significantly improving checkout productivity and ergonomics. Intelligent decoding software integrated with the scanner allows the scanner to read poorly printed and truncated labels.
Venture Development Corporation (VDC) ranked Datalogic Scanning first in a study of stationary bar code scanner shipments in both 2004 and 2005. In particular, Datalogic Scanning asserts that the German patent 44 47 992 covers bi-optic scanners that effectively scan on five or six sides of an object.
